Office of Student Conduct
The Office of Student Conduct supports the mission of the College by resolving complaints under the Student Code of Conduct in order to maintain a safe and positive learning and working environment for all members of the College community through interventions that foster personal growth and development.
RCTC students, instructors and staff are entitled to a safe and positive learning and working environment. Behaviors which interfere with the educational purposes and administrative processes of the College will be addressed promptly and fairly for the safety and well-being of the College community.
As members of the Rochester Community and Technical College community, students assume an obligation to conduct themselves in a manner compatible with the College’s function as an educational institution and to comply with the laws enacted by federal, state, local governments and institutional policies. If this obligation is neglected or ignored by any student, the College must, in the interest of fulfilling its function, institute appropriate disciplinary actions which will be handled in an expeditious manner while providing for due process.
Fairness: The Office of Student Conduct values the importance of transparency and consistency within communication and procedure. Individuals are provided the opportunity to share their perspective and be listened to with impartiality in order to have a timely and just resolution.
Respect: The Office of Student Conduct recognizes the dignity of each student to be treated as an individual with rights and responsibilities. Equal consideration is provided for all involved in the misconduct process regardless of status or position.
Responsibility: The Office of Student Conduct works to assist students in understanding personal accountability for individual actions and behaviors and to motivate changes in behavior(s) that are in conflict with College expectations and standards.
Community: The Office of Student Conduct balances the individual development and educational needs of students with a commitment to maintaining a safe and positive learning and working College community.
Integrity: The Office of Student Conduct strives to enact all values that are espoused and consistently follow College and Minnesota state policies and procedures to ensure objectivity and equitable resolutions.
RCTC students are responsible for knowing the information, policies and procedures outlined in the Student Code of Conduct.
The College reserves the right to make changes to this code as necessary and once those changes are posted online, they are in effect.
Please, use this form to submit an Incident Report. Submission of this form to the College constitutes a complaint against the person referred and may result in the initiation of disciplinary procedures by the Office of Student Conduct.
Reports submitted will be reviewed Monday through Friday during business hours.
Informal Resolution Meeting
Based on the seriousness of the violation, an informal resolution hearing between a charged student and the Student Conduct Coordinator is scheduled. The Student Conduct Coordinator’s role is to be an objective party, aware of and knowledgeable about the Student Conduct Code and hearing procedures.
If a resolution is reached, the parties shall sign the written confirmation of the resolution and the Coordinator shall send copies to all parties, including any applicable sanction(s), within 48 hours of the meeting.
The resolution may include, but is not limited to, the sanctions outlined in the RCTC Student Conduct and Academic Dishonesty Policy.
If a mutually acceptable resolution cannot be reached during the informal resolution meeting, the Student Conduct Coordinator shall refer the case to the Behavior Intervention Team for further action.
Student Judicial Board Purpose and Procedures
The Student Judicial Board is the College body responsible for adjudicating conduct cases referred to it by either the Student Conduct Coordinator or the Behavior Intervention Team. It determines the sanctions, if any, that should be applied when a charged student is found in violation of the RCTC Student Conduct Policy.
The Student Judicial Board consists of two faculty members appointed by the respective Faculty Association(s), two administrators appointed by the President and two students appointed by the Student Senate. Judicial Board members serve for a one-year term and may be reappointed for a second term and do not serve more than two consecutive terms. A majority of the full membership of the Board shall constitute the quorum necessary to hear any case.
Student Judicial Board hearings are held in closed session unless the Judicial Board determines there is a compelling reason for the hearing to be open and neither the accused student nor the complainant presents an objection.
Charged students are given the opportunity to speak in their own defense and to question any witnesses and may have an advisor present
Upon conclusion of the hearing, the Judicial Board will consider the evidence presented and decide by majority vote to exonerate the student or to impose one of the sanctions stated in the RCTC Student Conduct Policy.
1. Warning - A notice in writing to the student that the student is violating or has violated institutional regulations
2. Probation - A written reprimand for violation of specified regulations. Probation is for a designated period of time and includes the probability of more severe disciplinary sanctions if the student is found to be violating any institutional regulation(s) during the probationary period.
3. Restitution - Compensation for loss, damage or injury. This may take the form of appropriate service and/or monetary or material replacement.
4. Discretionary Sanctions - Work assignments, service to the College or other related discretionary assignments (such assignments must be coordinated by the Student Conduct Coordinator(s)).
5. Suspension - Denial of the privilege of enrollment for a specified period of time after which the student is eligible to return. Conditions for re-admission may be specified.
6. Expulsion - Permanent separation of the student from the College.
7. Summary Suspension - A suspension imposed by the Student Conduct Coordinator(s) or a person in authority without a formal hearing to ensure the safety and well-being of members of the College community. In such cases the Coordinator shall first give the student oral or written notice of the intent to determine whether a summary suspension is an appropriate action. Such notice shall state the following:
a) specify the alleged violation(s) of the Code of Student Conduct;
b) provide the nature of any evidence in support of the charge;
c) state the date, time, and place of the summary suspension hearing, which shall be within 36 hours of the delivery of notice to the student; and
d) give an oral or written explanation of the summary suspension which may be imposed on the student.
Appeals Purpose and Procedures
Charged students may appeal a decision reached by the Judicial Board to the Vice President of Academic Affairs, if the charges are related to academics, or the Vice President of Student Affairs and Enrollment Management within five (5) school days of the Board’s decision.
Written appeals will be delivered to the Office of the appropriate Vice President or Chief Officer.
Appeals will be limited to the following purposes:
1. To determine whether the original hearing was conducted fairly in light of the charges and evidence presented, and in conformity with prescribed procedures allowing the accused student a reasonable opportunity to prepare and to present a rebuttal of the charges and evidence.
2. To determine whether the evidence confirmed that a violation of the Code of Student Conduct occurred.
3. To determine whether the sanction(s) imposed are (were) appropriate for the specific violation of the Student Code Conduct.
The Chief Officer may uphold the Judicial Board’s decision and sanction, may determine that the decision was reached in error or inappropriately, or may determine that the sanction was inappropriate. In the latter case, the Chief Officer may issue a lesser sanction. If the Chief Officer believes that the sanction was reached in error or inappropriately, the Chief Officer may require that the Board hear the case again or may choose to exonerate the student.
The Chief Officer will notify the student in writing of the decision and of any new sanction imposed. The Chief Officer’s decision will be final with the institution and MnSCU.
If the sanction involves suspension for 10 days or more, the student shall be informed of the right to contested case hearing under Chapter 14 of Minnesota Statutes, which provides that an appeal may be made to an administrative law judge at the Minnesota State Hearing Examiners Office, St. Paul, Minnesota. The student may request a hearing in writing within five (5) days of receipt of written suspension notice. If the student does not file an appeal with the five (5) days, any further right to appeal shall be waived.
